Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the cupresto app ("cupresto", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use cupresto.

These Terms constitute a legal agreement between you and Buskers Brew LLC ("we," "us," or "our"), the company that operates cupresto.

2. Eligibility

You must be at least 16 years old to use cupresto. By using the app, you confirm that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

When you create a cupresto account, you are responsible for:

• Providing accurate information during registration
• Keeping your password secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at hello@cupresto.app

You may not create accounts for other people without their permission, or create multiple accounts to circumvent restrictions or limits.

4. Subscriptions, Billing and the Founder Lifetime Plan

Free Plan: Available to all users at no charge, with the features described in the app. No payment required.

cupresto Pro: A paid subscription billed monthly at $6.99/month or annually at $59.99/year. Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date. You will retain Pro access until the end of your paid billing period after cancellation.

Founder Lifetime Plan — Important Terms:

The Founder Lifetime plan ("Lifetime Plan") is a one-time payment of $150 available exclusively to the first 150 members. By purchasing the Lifetime Plan, you receive access to all cupresto Pro features for as long as the cupresto application remains in active operation by Buskers Brew LLC.

"Lifetime" defined: The term "lifetime" in the Founder Lifetime plan refers to the lifetime of the cupresto application, not the lifetime of the purchaser. Specifically:

• "Lifetime access" means you will not be charged a recurring subscription fee for Pro features for as long as cupresto remains an active, operating application.
• If cupresto is discontinued, shut down, or ceases operation permanently, the Lifetime Plan terminates along with the service. No refund will be issued in this event beyond what is required by applicable law.
• If cupresto is acquired, merged, or restructured, the new operator will be informed of all active Lifetime Plan holders and reasonable efforts will be made to honor existing Lifetime Plans. However, this cannot be guaranteed in all circumstances.
• The Lifetime Plan is tied to your individual account and is non-transferable. It cannot be sold, gifted, or assigned to another person.
• "All Pro features" means the Pro feature set as it exists at the time of your purchase, plus any new Pro features added in the future while cupresto remains operational. We are not obligated to maintain any specific feature indefinitely, but we commit to providing a meaningful Pro experience for all Lifetime Plan holders.

Founder perks included with the Lifetime Plan:

• Permanent Founder badge displayed on your cupresto profile
• Your name listed on the cupresto Founders Wall within the app
• One complimentary cupresto™ or Buskers Brew® branded mug, shipped to the address you provide at checkout
• Direct access to provide feedback and feature input to the Buskers Brew team
• Priority support from the Buskers Brew team

Physical items: The complimentary mug included with the Lifetime Plan will be shipped within 4 weeks of purchase to the shipping address provided. You are responsible for providing an accurate shipping address. We are not responsible for items lost or delayed due to incorrect addresses. The mug is a one-time item — replacements are not provided except at our discretion.

Availability: The Founder Lifetime plan is strictly limited to 150 members. Once 150 plans have been sold, this offer will be permanently closed and no further Lifetime Plans will be made available at any price.

Cancellation and Refunds:

• Monthly and annual Pro subscriptions may be cancelled at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods except where required by law.
• The Founder Lifetime plan is non-refundable except where required by applicable consumer protection law. If you believe you are entitled to a refund under applicable law, contact us at hello@cupresto.app within 14 days of purchase.
• Refunds will not be issued if your account is terminated due to a violation of these Terms.

Price changes: We may change monthly and annual subscription prices with 30 days' advance notice. If you disagree with a price change, you may cancel before it takes effect. Lifetime Plan pricing is fixed at the time of purchase and will not change for existing Lifetime Plan holders.

All payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.

5. The AI Coffee Coach

The cupresto Coach is an AI feature powered by Anthropic's Claude API. It is designed exclusively to answer coffee-related questions and provide brewing advice.

You agree not to attempt to:

• Circumvent the Coach's coffee-only focus through prompt manipulation or jailbreaking
• Use the Coach to generate harmful, illegal, or offensive content
• Systematically extract or scrape responses for commercial use

The Coach provides general brewing guidance only. It is not a substitute for professional advice in matters of health, safety, or equipment use. We are not liable for any damages arising from following the Coach's recommendations.

AI responses are generated automatically and may occasionally be inaccurate. Always use your own judgment when following brewing advice.

Pro users receive up to 25 Coach questions per day. This limit may be adjusted with reasonable notice.

6. Community Rules — The cupresto Bar

The cupresto Bar is a community space for coffee lovers. By posting content, you agree to the following rules.

You must not post content that:

• Is abusive, harassing, threatening, or discriminatory toward any person
• Is spam, advertising, or promotional material unrelated to coffee
• Contains misinformation that could be harmful
• Violates the intellectual property rights of others
• Is illegal under applicable law
• Contains personal information about others without their consent

We reserve the right to remove any content that violates these rules and to suspend or terminate accounts of repeat offenders, without notice and without refund.

Your content: You retain ownership of content you post. By posting, you grant cupresto a non-exclusive, royalty-free licence to display your content within the app. We will not use your content in advertising without your explicit consent.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of cupresto
• Use automated tools to scrape or extract data from the app
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use the app for any illegal purpose
• Interfere with the operation of the app or its servers
• Misrepresent your identity or affiliation
• Resell, sublicense, or commercially exploit access to cupresto or its features

8. Intellectual Property

Ownership. cupresto, including all software, source code, design, user interface, graphics, badge illustrations, brew method icons, written content, AI prompts, data structures, and all other materials contained within the application (collectively, the "Works"), are the sole and exclusive property of Buskers Brew LLC. All rights are reserved.

Copyright. The Works are protected by United States and international copyright law. Copyright © 2026 Buskers Brew LLC. All rights reserved. Unauthorized copying, reproduction, modification, distribution, public display, or creation of derivative works from the Works, in whole or in part, without the prior written consent of Buskers Brew LLC is strictly prohibited.

Trademarks. "cupresto," the cupresto logo, the CU cup lettermark, "Your Coffee Companion," and associated visual identity are trademarks of Buskers Brew LLC. "Buskers Brew" and the Buskers Brew logo are trademarks of Buskers Brew LLC. You may not use these marks without prior written permission.

Your Content. You retain ownership of content you create within cupresto, such as journal entries, passport stamps, and brew recipes you share. By posting content, you grant Buskers Brew LLC a non-exclusive, worldwide, royalty-free license to display and distribute that content within the cupresto platform.

DMCA. If you believe content within cupresto infringes your copyright, contact us at hello@cupresto.app with a description of the allegedly infringing material and your contact information.

9. Third-Party Services

cupresto integrates with third-party services including Stripe (payments), Anthropic (AI Coach), Spotify (Brew Soundtrack), and Buskers Brew (shop). Your use of these services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

cupresto is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses. We make no warranty about the accuracy or reliability of AI Coach responses.

To the maximum extent permitted by law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Buskers Brew LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of cupresto.

Our total liability to you for any claims arising from these Terms or your use of cupresto shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow limitations on liability — in those cases, the above limitations apply to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Buskers Brew LLC, its directors, employees, and agents from any claims, losses, damages, and expenses (including legal fees) arising from your violation of these Terms, your use of cupresto, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms, if required by law, or if we discontinue the service. Upon termination, your right to use cupresto ceases immediately.

If your account is terminated due to a violation of these Terms, no refund will be issued including for Lifetime Plan purchases.

You may delete your account at any time via account settings or by emailing hello@cupresto.app. Cancellation of a paid subscription does not automatically delete your account.

14. Service Discontinuation

We intend to operate cupresto indefinitely, but we cannot guarantee the app will remain available forever. In the event that we decide to discontinue cupresto permanently, we will:

• Provide at least 90 days' advance notice to all registered users via email and in-app notification
• Cancel all active recurring subscriptions and issue prorated refunds for unused paid periods
• Make reasonable efforts to allow users to export their journal entries and passport data before shutdown

Founder Lifetime Plan holders will receive the same 90 days' notice. No refund will be issued for the Lifetime Plan in the event of service discontinuation, as the plan is explicitly sold as access for the lifetime of the application and not a perpetual guarantee of service.

15. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida, and you consent to personal jurisdiction there.

If you are a consumer in the EU or UK, you may also have rights under the mandatory consumer protection laws of your country of residence that cannot be waived by this agreement.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or by email at least 14 days before they take effect. Continued use of cupresto after changes constitutes acceptance of the updated Terms. If you do not agree with updated Terms, you may cancel your subscription before the changes take effect.
